Terms & Conditions (Including SMS Terms)

These Terms & Conditions ("Terms") govern your use of the HealthNerd® website and services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Service.

1. Nature of Our Service

HealthNerd® is an independent health insurance advisory service. Premium estimates and plan comparisons provided via our tools are illustrations based on carrier guidelines and general market data, and are subject to underwriting approval and final policy issuance by the respective insurance carrier. Quotes do not constitute an offer of coverage until formalized application submission and binder receipt.

2. Licensed Operations

Our licensed agents are contracted across 50 states to broker private PPO and public ACA Marketplace policies. Licensing and appointment details are available upon request. We do not provide tax, legal, or medical advice; consult a qualified professional for decisions requiring such advice.

3. SMS Messaging & A2P 10DLC Consent

Opt-in. By providing your mobile telephone number on a HealthNerd form and affirmatively checking the SMS consent box, you expressly agree to receive recurring automated SMS text messages from HealthNerd and its licensed advisors at the number provided. These messages may include health insurance plan information, consultation scheduling, appointment reminders, and follow-up communications related to your request.

Message frequency. Message frequency varies but is limited to what is reasonably necessary to fulfill your request (typically 1–4 messages per month). Standard message and data rates may apply according to your mobile carrier plan.

Opt-out. You may opt out of all SMS communications at any time by replying STOP to any message. You will receive a one-time confirmation message confirming your opt-out. No further SMS messages will be sent unless you re-subscribe.

Help. For support at any time, reply HELP to any message or email support@healthnerd.net.

Carrier compliance. SMS messages are transmitted via mobile carriers and messaging partners under the A2P 10DLC framework. We comply with all applicable carrier content policies and the CTIA Messaging Principles and Practices. Carriers are not liable for delayed or undelivered messages.

No sale or rental of mobile numbers. We do not sell, rent, share, or otherwise transfer your mobile number or SMS consent to any unaffiliated third party for marketing purposes.

4. No Spam & Telemarketing Compliance

HealthNerd does not engage in unsolicited telemarketing, robo-calling, or bulk SMS marketing. All outbound communications require your prior express written consent. We honor all federal and state Do-Not-Call list registrations and the FCC Telephone Consumer Protection Act (TCPA).

5. User Responsibilities

You agree to provide accurate, current, and complete information when interacting with our Service and to update such information as necessary. You agree not to misuse the Service, including by attempting to disrupt its operation, submitting false or misleading information, or accessing data without authorization.

6. Intellectual Property

All content on this website—including text, graphics, logos, and software—is the property of HealthNerd® or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Plan pricing and availability are subject to change without notice.

8. Limitation of Liability

To the maximum extent permitted by law, HealthNerd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service, including but not limited to any reliance on plan estimates or comparisons displayed on the site.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which HealthNerd is licensed, without regard to conflict-of-law principles. Any disputes shall be resolved in the appropriate courts of that jurisdiction.

10. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
